1. IDENTIFICATION
Curated is a trading name of Oso Hospitality Group SL, registered in Spain. Hereinafter referred to as "Curated", "we" or "the company".
2. SCOPE AND NATURE OF SERVICES
Curated provides concierge, organisation and intermediary services for experiences and activities within the Valencian Community. Depending on the nature of each service, Curated may act:
a) As direct organiser, when the experience is designed, coordinated and delivered under the supervision of Curated.
b) As intermediary or agent, when Curated acts as a link between the client and an external service provider (restaurants, charters, guides, wineries, private venues, etc.). In this case, the service contract is established directly between the client and the provider, and Curated's responsibility is limited to the management of the booking.
Curated operates within the Valencian Community. At the express request of the client, Curated may provide guidance or assistance in sourcing services outside this territory, without guaranteeing the availability or quality of providers outside its established network.
Curated's services do not constitute combined travel packages within the meaning of EU Directive 2015/2302 or Spanish Law 23/2018, unless expressly stated otherwise in a specific written proposal.
3. BOOKING AND CONFIRMATION
The booking of any Curated service begins with a client request via our available channels (WhatsApp Business, email, or other agreed means).
A booking is considered confirmed only once the client receives written confirmation from Curated. A request alone does not create an obligation to provide the service.
Curated reserves the right to decline any request that cannot be fulfilled due to availability, operational feasibility, or any other justified reason.
4. PRICING AND PAYMENT
Prices stated in Curated proposals are indicative and may vary depending on the date, number of guests, season, and provider availability.
The final price will be the one confirmed in writing in the formal proposal sent to the client.
Payment: Curated will inform the client of the applicable payment method on a case-by-case basis. This may include full advance payment, a booking deposit, or payment upon completion of the service, depending on the nature of the experience booked.
All prices include VAT as applicable under current Spanish tax regulations.
5. CANCELLATION POLICY
The cancellation policy varies depending on the nature of the service and the conditions imposed by the external provider involved. Specific conditions will be stated in each booking confirmation.
As a general rule, unless otherwise stated:
Cancellation more than 7 days in advance: full refund of any amount paid, minus any management costs already incurred.
Cancellation between 3 and 7 days in advance: 50% refund of the amount paid.
Cancellation within 72 hours: no refund.
No-show: no refund.
For experiences involving providers with stricter cancellation conditions (one-off events, private access, charters, restaurants with waiting lists, etc.), the provider's conditions will prevail and will be communicated to the client prior to confirmation.
6. AMENDMENTS
Clients may request amendments to a confirmed booking with a minimum of 48 hours' notice before the start of the service, subject to availability and the conditions of the external provider. Curated cannot guarantee that amendments will be possible once a booking is confirmed.
7. LIABILITY
7.1 Own services. When Curated acts as direct organiser, it is responsible for the correct delivery of the service as agreed.
7.2 Third-party services. When Curated acts as intermediary, responsibility for the execution of the service lies entirely with the external provider. Curated accepts no liability for cancellations, amendments, accidents, damage, delays or any incident caused by the provider, or for events of force majeure.
7.3 General limitation. In no event shall Curated's liability exceed the total amount paid by the client for the service in question.
7.4 Insurance. It is the client's responsibility to arrange any travel, cancellation or accident insurance they consider appropriate. Curated does not include insurance coverage in any of its services unless expressly stated.
8. CLIENT OBLIGATIONS
The client agrees to:
Provide accurate and complete information at the time of booking.
Respect the schedules, conditions and rules of the providers and venues involved in the experience.
Notify Curated in advance of any special requirements, allergies, medical conditions or restrictions relevant to the service.
Pay the agreed amounts within the established timeframes.
Curated reserves the right to cancel or terminate a service without refund in the event of inappropriate client behaviour that compromises the delivery of the experience or the relationship with the provider.
9. DATA PROTECTION
Personal data provided by the client will be processed in accordance with EU Regulation 2016/679 (GDPR) and applicable Spanish legislation, solely for the purpose of managing the commercial relationship and delivering the contracted services.
Data will not be shared with third parties except for the providers strictly necessary for the delivery of the contracted service, and always within the applicable legal framework.
Clients may exercise their rights of access, rectification, erasure, objection and portability by contacting Curated through our official channels.
10. INTELLECTUAL PROPERTY
All content, materials, proposals, catalogues and documents produced by Curated are the intellectual property of the company and may not be reproduced, distributed or used for commercial purposes without express written authorisation.
11. GOVERNING LAW AND JURISDICTION
These terms and conditions are governed by Spanish law. For any dispute arising from the contractual relationship, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Valencia city.
12. AMENDMENTS TO THESE TERMS
Curated reserves the right to amend these terms and conditions at any time. The version in force will always be the one available through Curated's official communication channels. Booking any service implies acceptance of the terms in force at that time.
